Judge in Phantomlord case rules clause in Twitch contract was unconscionable TwitchThe first crucial decision in the Phantomlord vs Twitch lawsuit was reached yesterday when Judge Karnow of the Superior Court of California ruled that the limited liability clause in James Varga’s contract was unconscionable. Varga, who was removed from the Twitch platform for running a skins gambling casino where he seemingly rigged outcomes in his favour, has been embroiled in legal action against the streaming platform on the belief his ban was unfair. The first point of contention was a “limited liability clause” in his contract, designed to limit how much he could have claimed in damages should a court rule in his favour. Twitch’s contract included a $50,000 limit on any damages parties could claim from one another in the result of a lawsuit, a clause that is understood to be included in other contracts issued to streamers at that time. The judge’s ruling now opens the door to Varga being able to make a claim for damages in excess in $50,000 although this ruling in no way passes judgment on the validity of such a case. In contract law, unconscionability is a term used to describe a situation surrounding an agreement that is unjust or overwhelmingly one-sided, in favour of a party that has superior bargaining power, such that entering into the agreement would be contrary to good conscience to the party negatively affected. 700Following a three day hearing in August that included live testimony, presentation of evidence and analysis of depositions, the court was given the task to go over each of the arguments presented by Varga’s legal counsel. The judge concluded that there was indeed some procedural unconscionability on the basis of “oppression” when it came to contract negotiations. “Varga had some college education, had been in contractual relationships before, such as with Own3d and others” the court document reads, “but as I note below there was a significant disparity in legal sophistication and Varga did not use an attorney. These factors on balance suggest some oppression.” The judge also observed that some procedural unconscionability was present due to Varga not understanding the significance of his bargaining power at the time of negotiations. When it came to the matter of substantive unconscionability, meaning the terms of the contract are objectively unfair as presented, the judge ruled that the clause alone was so one-sidedly in favour of Twitch that he couldn’t view it any other way. “Varga’s monthly income averaged over $5,000 per month and appeared to cluster around $10,000 per month… so the $50,000 cap is incommensurate as to be unconscionable” Judge Karnow wrote. The judge also added in their conclusions “there is no reason to limit Varga to $50,000 when he might be entitled to a much, much higher sum… From a practical point of view, which I think is essential consideration, limiting recovery to $50,000 virtually kills off the odds of a suit against Twitch at all. The agreement doesn’t appear to have an attorney fees clause and few – if any – lawyers would take on a contingency case against Twitch for some reasonable percentage of $50,000. The cap is unconscionable.” Several other of Varga’s arguments were shot down by the judge, including one where he claimed to have not read the contract, that was sent to him electronically via Hellosign, because he didn’t know he could scroll down through the pages. “I think if you hit the scroll wheel, it might work” Varga said during a deposition “but there was a big button for me to ‘sign here,’ ‘continue’ and that’s what’s like in different colours. So I clicked that as thinking that’s what I had to do.” “So you just had to do that” came the follow-up question. “You couldn’t scroll around and take a look at the agreement?” “Again, I didn’t know if that’s what needed to be done” Varga responded. The judge decided this explanation was insufficient to explain why Varga had not read the contract. “I find the suggestion, if that is what it is, incredible” they said. “Varga, who spent virtually all his waking hours on computers and was familiar with a variety of programs knew he could scroll through the agreement… He simply chose not to do so.” While the ruling of unconscionability will come as a blow to Twitch in this case, it was also expressly stated that this ruling does not affect claims for intentional misrepresentation, negligent misrepresentation or section 17200 of the Business and Professions Code, which refers to unlawful, unfair or fraudulent business acts. These are all components of Twitch’s counter-filing against Varga. There will now be a case management conference to discuss what happens next in this landmark case.

In April, the court ruled that Twitch had to pay Phantoml0rd $20,720.34 in damages, over a dispute which arose from Twitch’s decision to permanently ban the streamer in 2016. However, although Varga ‘won’ the lawsuit “on all counts” (in his own words), Judge Curtis E.A Karnow’s statement of decision on September 1 reveals more about the proceedings, and why Varga’s legal team failed in their pursuit of tens of millions in damages. At the outset, “Varga’s counsel alleged to damages in the range on $15 million to 100 million.” This request was then revised to only $12 million, before later being raised again to as much as $63 million. In the end, the $20,720.34 was largely due to the jury finding that Twitch had violated a provision in Varga’s contract that he should receive 30-days notice before being banned. Phantoml0rd claimed he was ‘singled out’ During the case, it was argued by Varga’s team that Twitch had treated him unfairly, compared to other streamers, namely Sodapoppin. The judge explains it was argued that “Varga was the ‘scapegoat’ and although he was banned, another popular but similarly abusive streamer named Sodapoppin was not banned.” “This was one of Varga’s core themes at trial. Twitch noted Varga’s extraordinarily high number of violations and Varga retorted with Sodapoppin’s 34 violations.” However, Twitch argued that each streamer’s “disciplinary record” is treated separately, on a case-by-case basis. The judge also went into detail about Phantoml0rd’s violations on the Twitch platform, which include passing out drunk, “simulating sexual intercourse”, as well as sexually suggestive and racist content. Phantoml0rd testified he didn’t know about TOS It is also told how Phantoml0rd claimed under oath that he “didn’t know about the TOS” (Twitch’s terms of service), or “didn’t recall”, but the judge found that he was not telling the truth. Because, it was made abundantly clear to all in the courtroom that Varga did in fact know about the TOS, when they were “shown a YouTube video which Varga posted which shows Varga looking at Twitch’s TOS and rules of conduct in 2016.” The judge also noted that “Varga had other serious issues with his credibility, too.” Judge sides with Twitch on ban decision Finally, the judge concluded that Twitch benefitted “the real consumers here who are the viewers (including teenagers) who no longer were exposed to his abusive behaviors. “While consumers might have been disadvantaged by not being able to watch Varga’s high-quality gameplay on Twitch (a consumer injury Varga never argues), they can do so on e.g., YouTube.” In conclusion, the judge expects Twitch will not repeat its “ham-fisted” response to Varga’s “abusive actions”, as the lawsuit itself cost the streaming platform “almost half a million dollars on its expert, and I expect attorney’s fees far exceed that. That should be enough to get Twitch’s internal legal team motivated.” In the claim of unfair competition law (UCL), the judge states “judgement should be entered for Twitch and against Varga on the UCL claim.”

Basically, in the last few weeks Dobrik has come under fire for a host of allegations including sexual assault, bullying and harassment against him and his Vlog Squad based on content from a number of years ago. Dobrik and Peck, of Drake and Josh fame, have been friends for a while now, frequently seen hanging out and featuring in one another’s content on YouTube. However, as of April 3, all traces of the YouTuber seem to have vanished from Peck’s Instagram page. According to YouTuber Def Noodles, Peck apparently has scrubbed every mention and picture of Dobrik from his account going all the way back to 2019, when Dobrik won a Nickelodeon’s Kid Choice Award. It’s not known exactly when all of the content was deleted either, but it seems to have been very thorough, with no trace of the YouTuber to be found in his images whatsoever. And while the platform us yet to confirm what it was that got Zherka banned, as Twitch often refused to provide crystal clear explanations, he believes that it was “for getting too edgy and also aiding in the ban evasion of Gross gore.” Adding at the end of his Twitter post that “attempts at comedy keep failing” and pairing these words with an image of Joaquin Phoenix’s Joker. JonZherka banned on Twitch for the second time This isn’t the first time that Zherka has been banned on Twitch, however. Back in March 2021, he was hit with a month-long suspension on the platform. Brady took to social media on Monday to describe one of many hospital holds that she’s had, saying that the Hawaii Queen’s Health System strapped her down and shoved a mask in her mouth while covering her face with “mesh s—t” before laughing at her. She also stated that she was treated like a “street dog” while placed on the most “violent” mental health hold that she has ever experienced, as she’s been involuntarily admitted about a handful of times. Brady also shared that medics at the hospital refused to give her water, saying, “I asked for water. They did not give me any. They dragged me by my arms and strapped me down on a gurney WITHOUT MY CONSENT.” Brady continued to explain her experience, saying, “This is not my first experience with involuntary hospitalization without due cause, or without a clear determination that I was a threat to the safety of myself or others, which is the legal definition requiring to involuntarily hospitalize someone.” Though Hill has not commented on his exes’ hospital experience, Brady is nonetheless out of her mental health hold. He then called out Twitch over ‘hypocrisy’ amid the so-called ‘hot tub meta’.
